I decided to pay a Collections company a one-off payment via direct debit for a monthly amount owed. The next month, they automtically deducted the same figure from my account without contacting me! (I had sent in a cheque as payment) The bank confirmed that a direct debit was not set up, which had it happened, they could help me. As it was a single debit, I'm on my own. The Collections company will check their phone message to confirm that I did not agree to a direct debit - but they are notoriously unreliable and have quite a bad reputation (as I garned ftrom the net)...is there anything else I can do? I think this should be highlighted to the FSA...but do Collections agencies authorised by FSA?

When setting up a direct debit, companies usually assume you will use that payment going forward and require notification in writing to stop it. Your bank will have a direct debit set up or else they wouldn't be able to take the money, speak to your bank, they can stop any direct debits if you tell them and cancel your cheque, don't pay them twice. If you owe them money, depending on the wording on the direct debit mandate, your stuck with it.

You had a roque collection agencey. Ring your Bank and stop all direct Debits and let the ethical one's contact you again to set up from the start. Than ask for the Direct Debit that was deducted from your account and the rule under the DD guarantee,they must refund you the money as the Bank will contact the rogue agency. Do this first and see how you go. Never ever part with money to any one unless if you are indebted to ??? than pay them directly if it is only a £1 a month they will kiss your /? for it.

Has your bank explained to you how this company managed to take funds from your current account without a Direct Debit being set up? If you asked your bank to send a one-off payment to this company, that is NOT the same as sending them a Direct Debit payment. A Direct Debit is where the company is able to 'call' for the money from your account on a weekly/monthly basis.
If I were you, as well as speaking to the collection agency to get my money back, I would be questioning my bank as to how this was allowed to happen.

if you sent a cheque to them, they CANNOT use those bank details to set up a direct debit, do not bother waiting for them to check the phone call, because this will never happen.
Demand to speak to a manager, if they refuse, say you will take it further. Write down all names, dates and times. If the manager does not help, tell them you will take it further, get as many names of superiors as you can, and then quote them everytime you speak to them.
If you are still not getting anywhere, tell them you will take it to the national newspapers. And you will sue them for undue stress.
You will see how fast they sort it out.
Just out of interest, which credit agency is it?

I think you should ask for the second amount to be refunded by the bank and tell the bank you want them to look into it as fraud. Likewise, write a recorded delivery letter to the company that did the payment and unless they sort it out in so many days you will be lodging a fraud complaint with the local police.
That might get things moving.

For me its illegal. File a complaint to the company furnish copy to the bank and consult lawyer.

If they have taken the money without your permission - it is theft! Thebank can provide evidence that no DD was in place - report to police as theft - they can prosecute!
