Usually its split 50/50..although if children are concerned the partner who has them full time should live in the home until other arrangements are made.

That depends...
If it has a mortgage, it should be sold.
If it doesn't have a mortgage and originally belonged to one of the 2 people then it should remain that person's property.
If they bought it together, the equity should be split. That would normally mean selling the home.
Marrying a guy who has a house then divorcing him a year later does not entitle the woman to the house.

I am going to have a go at answering this one for you, If as I assume you are going through a divorce, then the marital home will have to be sold and the proceeds devided between the husband and the wife of the divorcing parties, and by todays house prices you should both come through it all, rewarded accordingly. about one in three marriages end in the divorce court, which is a pity really, my wife and I have been happily married for 42 years, and the house is all paid up, and we were frightened to hear of its value recently when A NIEGHBOUR SOLD THEIR HOUSE AND PROMPTLY RETIRED, as they were going to live in his mothers house left to them in a will. they are a little older than we are. so I hope they enjoy their retirement. and I hope this helps you in the answer you were seeking. bye ............ that depends on whether you have children or not. If your the main parent then you would be allow to stay in the house, if not then you would have to leave the house. If you dont have any children then you would both have to sell the house and split the proceeds. If one of you want to keep the house then the other can offer to buy you out. Any agreemant needs to be written uo by a solicitor to protect you both.

It depends on whether there are children involved or not and whether it is a private or joint tenancy rented property.
If the relationship has broken down amicably and you can settle things together, I suggest you do it that way otherwise it will start to get messy. enquire with a family solicitor for legal advice it will cost you £125.

speakin on behalf of both girls and boys, my wife died sometime ago and i met someone else who has just successfully taken me to the cleaners, and we were not married. this has also happened to girls i know. marital homes dont appear to exist any longer
