I have been overpaid by 500.00.
I notified the benefit office on the 8th Dec 06 of a change of circumstance, yet I had a letter on the 18th Feb saying that they were only notified on the 6th Feb 07 and I owe them.
I have reciepts to show that I notified them.....how do I appeal when I feel it is their fault for taking 3 months to sort it???

If they have given you the money, then you still have to pay it back to them, I was overpaid £323 and I arranged with them to pay it back £20 a month

Well at the end of the day the overpayment they gave you may be their mistake, but you will have to pay this back even though you notified them.

It is not your money and reason says you had no right to it, as with any government organisation, things take time to process.

Although I do admit it would be nice if they did have a formal procedure that after a certain amount of days if money is not reclaimed it is yours.

Banks do the similar thing, and as you may have read in the papers in the past, monies wrongfully credited into an account are duly taken back of the customer.

You have to look at it in retrospect, if you got a mini cab you gave him a £20 instead of ten, I am sure when you realised this you would ring the company demanding your money back.

Be fair errors are made, but nothing is free in life.

even though it is their fault - you have been overpaid and will have to pay it back. The not your fault bit would help if you go to court, because it will mean you might get easier repayments, but it could also be argued that you knew you were being overpaid so you should have put the overpayment to one side until the council asked for it back.

This sounds like a tuffy--I've had similar situation, and I always ended in return of the extra money after all. Either return, or credit my account. you could call a agency that could help you sort out the mess. Good Luck!

you nonetheless could pay it returned ,yet take it sluggish it replace into there fault .i replace into charged for hire as quickly as I should not be because of the fact i'm getting under the regulation says i could stay.they took £a million,six hundred and that i in basic terms stumbled on it as quickly as I went fix something else ,i've got been given it returned,they publicise whilst somebody cheats ,yet not whilst they make errors
