My employer still has not given me my W2 for 2006.
Is he breaking the law??

cantact a lawyer and sue them

They are supposed to have them out by the end of January. You could report him to the IRS but then you might lose your job.

Tell him you need to get your taxes done and ask him when they will be available.

Legally, they have to have them postmarked by January 31 if they are mailing them to you. Which by now, it should have reached you! If he has them in his possession and not given them to you yet or mailing them (which as I said, should have already went out), then I would say yes.
