When half of all American marriages end in divorce, it is ludicrous that a prenuptual contract is not part of the marriage process.
No one would ever take on a business partner without some legal understandings. More of those succeed than marriages.
The "burden" to the legal system would actually be less, since there would not be all the legal battles during the divorces.

If my lover told me he needed a prenup, I wouldn't marry him and he says the same with me. Mind you, we're both in major debt from school, so it's not like the pre-nup would have much purpose!

Yes. After all if the society is going to benefit in the process, it has to pay a price for it by creating additional infrastructure.

pre-nups are for people that don't trust the one they are with and don't plan to be with for the rest of their lives.
