He would have to adopt him. that is the only legal way about it. You would have ot have the biological fathers consent or go through a really tough court case to get it approved. however there is no reason your son can not just go by that name. Talk to his school you wuold be surprised at the amount of schools that will add the name. I know this because my sons school does it for him. They just add the step parents name on at the end so it is hypenated.

Your new husband does not give your son his last name, unless he adopts him. Your son would keep his biological father's last name just as it is on his birth certificate until his father gives up his parental rights and allows your new husband to adopt him.

I think he would have to legally adopt him and you might also have to do a legal name change like you would if you wanted to change your first name.

your old husband has to sign over all rights of your son and if not get a damn good lawyer im going through the same thing with my daughter and her dead beat dad

If the natural father is a deadbeat-then take him to court and force him to pay support-otherwise, tell him if your hub can adopt him you will let that go.

Two things. Your ex has to sign away his rights and your new husband must adapt him. I did the same thing. Just hire an aggressive lawyer, not the wimp I did.
