the mom is dead but the dad is alive who had children took out of home. the uncle now has custodian rights but the dad has his rights . how does this actually work?

Apparently dad was not taking proper care or could not take proper care of these kids. Who knows what the circumstances are. Custodian rights mean the uncle makes all the legal decisions for these children, protects and provides for them the same as if he were their parent. Must be a great uncle because having kids is a lot of responsibility. The dad could still have the right to visit and see the kids if the judge seen fit.
This of course is something that is settled in a court of law and a judge.

The court determines the fitness of the parent, and the most hospitable situation for the children regarding the ability of parent or guardian to care for and be available for the child. Something may have been determined that shows the father as not available to care for the child as a single parent without sufficient help in the home.

The law provides that the parents had parental authority but there are exceptions under the law when it is granted to other persons due to financial capability, abuse and others. In this case, the father could had been diallowed by the court and the parental authority was given to the uncle which can be supported by valid reasons under the law.

The judge should have spelled it all out at court when the children were taken away from the parent.
