That would be felony drunk driving that includes injury. Go after the person and his or her insurance company. A good attorney will take a case such as yours on a contingency,and I would find one that takes no more than 30% of your setlement. If it goes to a jury, you would likely get more money than If you settle out of court,but the process takes a lot longer to reach a conclusion.

Personally, I think you SHOULD receive enough to pay for all your medical costs, damages to your vehicle (or replacement), and for any lost wages (including leave time).
What you WILL receive is dependent on the driver in question. I was hit by a drunk driver once, but guess what? He was uninsured, unemployed, and eventually was sentenced to jail for a long period of time. I'm not getting a dime from the guy, and likely never will, despite the restitution awarded. The money has to come from somewhere, and this guy likely will never have any. So it depends on who hit you. If the guy's loaded, then maybe you'll get everything that is coming to you. If not, then you're likely out of luck.

Depending on your state, your insurance coverage, their insurance coverage, your medical, time out of work, your car, and pain and suffering should all be paid. However, if they have minimum coverage, or you didn't have un/underinsured motorist insurance and they are broke you are most likely out of luck. I am going through a similar situation, that took me out of work for 2 1/2 months, messed up my back and neck and also injured my 5 yr old daughter. His insurance is only paying out 100,000 for both of us and our medical bills are almost a much, and will likely be more before treatment is complete. If you decide to civilly sue the drunk driver, you may get more if he has it, or you will be paying a lawyer to get you a worthless piece of paper.

This is a tough question, it depends on how long you will miss work, medical expenses, cost of replacement vehicle, pain and suffering and if this is the first charge against the driver. Most Attorneys have guidelines they will follow depending on the state. Also a factor is the limits on the insurance policies in effect (yours and his). Good luck.

I think you should work it out with a lawyer and I think you should get the money to pay for all your bills that have come outa this and a brand new spankin car.
