Statistics have shown that driving with a cell phone, or driving while eating are just as or more dangerous than a drunk driver with a .08 reading. We have no problem sending the drunk to jail, but the others usually get off with no issue.
I feel that we need to be consistent in our punishment based upon the dangers that you are presenting (which is equal in my examples). Are our current laws fair ?

well, in parts of new jersey it is punishable by fine to drive w/a cell phone to your ear. you must use a hands-free device of some sort. drunk driving is inexcusable, i'm sorry... maybe when we see lots of stories on the news about people losing control of their vehicles while snacking on Doritoes and slamming into a car full of family/children and killing them all, maybe then there will be a 'DWE' driving while eating conviction....

No, they are not. Having a standard bac makes it easy for the police but it doesn't take into account peoples tolerance. A person who drinks fairly often is going to be less intoxicated at .08 then someone who rarely drinks will be at .04. They need to find a better system of deciding who is too intoxicated to drive. The police should have to rely solely on field sobriety tests in order to decide who is safe to be on the road and who isn't. Breathelizers and blood tests should only be administered after the arrest has been made to determine the intoxicating substance and the severity of the intoxication. I do believe that BAC should play a part in sentencing though.

no law is ever fair. who is to say what is a distraction? lack of sleep is probably worst of all, i did not see you mention that. the problem with these distractions it harder to define how much of a distraction they really are. who is to say how long you have to go without sleep before it is illegal. who to say that you can sip a soda while driving, but you can't eat a cheeseburger. you can talk on a cell but can't dial. you can dial on a cellphone but you can not send a text. testing if someone is drunk is a very simple procedure. you have all the motor skill tests and the BAC test.
