Can we file married but seperate and have one of us claim head of household.

Not when you live together and are legally married. That is against tax law.

No you can't and why would you if you do that you will not get the earned income credit if you are eligible and the head of household is in a higher tax bracket so it don't make any since. File married fileing jointly

interesting idea........get yourself turbotax and run through it with both options; taxes are higher if you file married but separate, Why don't you just file jointly and claim the son you have between you and whichever of the children you get to claim from your previous relationship....

oops...good idea gone bad...you cannot be married and file Head of Household

I think that with marriage there is no head of the home especially if you both are bringing in an income into the home you guys are partners. Its like a company running on a partnership. or that is just how I think of it as well as my husband.
