yes,my ex,I keep conveniently seeing him lately when I'm out driving and I had problems w/him before

Document EVERYTHING.... each time you see him not where, when , etc etc
Keeping records is imperative.... I was in a VERY similar situation....
If people witness him stalking you talk to them and note what they know. Make sure you are able to go back and get statements fromt hem later if need be.
Contact a police officer.... you can call or make an appt with someone usually..... explain you are concerned. If you can't get a restraining order right away than see if the officer will at least write a statement or report of your concerns for the future if needed. KEEPING TRACK OF ALL INFO IS SO IMPORTANT.Make safety plans for yourself, carry a cell phone... if you are scared some where get a security guard.... or just approach a stranger and tell them you need their help... call 911 if you need to at any time...... try not to go anywhere alone.\
Tell your friends and family you are worried so they can watch out for you too.

different states have different statutes, if he has ever assaulted you, you need to look into taking out a "protective order". In our state, Texas, a restraining order is a civil matter and you have to take that person back to court for violating it.

A protective order is another story, in Texas, if that person comes around you and the cops catch him---he has committed a criminal act punishable by jail. The more a person violates it the more the penalty is enhanced.
I would advise you to go and see your local district attorney and find out what your options are.

I don't think so, I believe a restraining order is issued when you have been physically hurt, or harassed repeatedly in a threatening manner (letters, messages, phone calls, breaking and entering, etc.)

Reporting this to the proper authorities is the first step. A good person to call for a really good answer to this question is to call your District Attorney's office first thing tomorrow.

Be sure what you say cause a person's reputation could be at risk and your judgment could end up questionable. BUT for God's sake stay safe at all costs.

no, you have to have physical proof and that they tried to hurt you, or harassing you, in order to get a restraining order on them.
