My husband and I received an offset notice. The offset is due to Child Support. My husband claims he has no children with anyone else. He believes someone set him up. I called an ex of his and she told me that he has two children with her and walked out on her while still pregnant on the second baby. My husband denies and he told me this ex is destroying him because they broke up in bad terms. She went ahead and filed child support on him without his knowledge and came out on our taxes. He wants to get paternity test and call a lawyer. I wonder if the only way to file child support is if his name is on the birth certificate of the kids. If so, I have a feeling he is the father of those two kids.

Nope. Otherwise, people would (and do) put just about anybody on there as the father, whether they truly are or not. In a court, genetics will trump anything on the birth certificate, because the Judges know that what is listed on the birth certificate is subject to who was there at the time of the birth, who the mother chose to have listed, etc. Requesting a paternity test and getting legal representation, as it appears you are doing now, would be his best bet to getting to the truth of the matter. Your sixth sense has kicked in for a reason. He knew that it would catch up with him at some point especially after a second kid, so, yes he's probably lying. Only, the name does not have to be on the birth certificate nowadays, because the first thing that will happen is what he's has no choice in and that's getting a DNA test. Just be prepared to get the papers, because this other female wouldn't have gone through all this for nothing, right.

It helps to have his name on the birth certificate. Without it, she will be ordered to have paternity testing done to prove he is the father, especially since he denies having any kids.

In the US, father is decided by DNA...elsewhere it can be the name listed as the father on the birth certificate, regardless of DNA, even if DNA proves he's not the biological father....sounds like he's the father though.

Sorry, until he proves by testing that he is not the father she can come after you guys,I would find out about stopping any payments on support while a case is pending cause it is very hard to get any moneys paid out, back, his kid[s] or not. GOOD LUCK!

your hubby doesnt want you to know his dirty little secret, and he thought it would just go away.

gone are the days of that happening. gone are the days of hiding til the kids hit 18, for today, arrears are forever. todays courts dont play. state and federal government are tired of parents not paying for thier kids, so they passed stronger laws for child support.

everyone is tired of deadbeat parents (male or female)

not on the birth certs? are you sure? even if not , the court will more then likely order DNA testing. once proven he is the father the income of BOTH parents are calculated, needs of children (such as medical insurance, daycare, etc), and an amount is set. most states goes by both parents incomes; and if one parent isnt working, an amount is calculated for them and added in.

i'm sorry you had to find out about it in such a way. if it were me, i'd wonder what else he isnt telling me... that would worry me. and now you get to pay for him walking around 'i'm not gonna give her shyt' mentality.

he knew... and thats grounds for divorce, for it could have effected your actually marrying him, who knows? but it sure will effect your future (living expenses, lifestyle).

lawyers will cost you money. to make you feel better, i'd consult one, but it costs nothing to go to court and have a DNA test ordered.
