I think this is a good case to be made for putting kids in adult prisons.

Ok, Adolf, let's not go sending adolescents to prison for spitting. He should be suspended from school, and, depending on the circumstances, expelled.

So you're saying a kid who clearly needs help and a better environment and real parents should be thrown in adult prison for spitting in someone's face?

I think perhaps getting the child into a decent home would be more beneficial.

He needs to be counseled to find out about his anger issues. Also there has to be consequences----take away something meaningful, have him stay after school for a long time, or grounded for a specific period. Really, a 12-year old is a child and this one did not do something that warrants prison. He does need guidance and reform now so he doesn't grow up to need an adult prison.

Added: I'm assuming it's a He.

You may not like my answer, but the little brat should have his @ss kicked and then his parents or lacking parents should have their @sses kicked too. I wasn't abused as a child, hell, I was rarely punished because I knew better, but my DAD would have tanned my hide for such an act. I would have been grounded from everything and I probably wouldn't have been able to sit for long periods because my @ss hurt so bad. Next, my father would have marched me to the school and I'd make a public apology for my actions to the teacher. The whole class would look on as the teacher received her/his due respect. The teacher wins the upperhand in the end.

Depends on the teacher, how/why did he engender so much hate, (by humiliating him?) Or it could depend on the kid, if the teacher really wasn't to blame and didn't mishandle the situation a short sharp smack in the face always used to work well.
Prisons breed prisoners and they are among the most expensive members of society in every way.

Gee, prison is a little harsh, isn't it? I mean, we have rapists running around free and all. I think the child should be required to do a paper on diseases transmitted by saliva, another essay on respect, a written apology to the teacher read in front of the class, and some privileges revoked.

Definitely expelled! Let the parents take care of this mess. Being expelled is not going to hurt the kid so much but the parents must be aware of this and they can not take this lightly that is why the kid must be expelled so the parents will be responsible for their kid's behavior. NO EXCUSE! Only in this country you get kids with no repect to elders nor anyone. ONLY in this supposedly the greatest country in the world. What hypocrisy!

I wouldn't go as far as adult prison. Maybe county jail for a month. This kid obviously has no respect for authority and if you were to spit back in his face, he may come back with a knife, or god forbid, a gun.It certainly needs to be addressed very forcefully and very quick.
