I don't consume marijuana in any form, and I never have, but can I get into legal trouble if someone I'm with is caught using marijuana?
Example: Some friends and I are hanging out in a dorm room. They are all smoking pot, but I am not. We are caught. Do I get in trouble?
OR
I am a passenger in a vehicle with a person who possessing marijuana. They are caught. Do I get in any trouble?

Specifically, what kind of trouble can I get into?
And can't they do tests or whatnot to prove I have no marijuana whatsoever in my system?
Finally, I live in West Virginia.

The best way to stay out of trouble is to keep away from trouble.

One time I was at work and I bought a bag of weed. My friend showed up and we went out into my car and started to smoke it. We didn't know(because we were very stupid) that the police were watching us the whole time. They waited for both of us to partake in the smoking process before they busted us. If it's your car and people are smoking, then yes you can get busted even if your not smoking. If it's not your car and you don't appear "high" then you should be fine with a half-way decent lawyer or trying to talk your way out of it. On the dorm front I would ask that your roomate not smoke when you're in the room. This way when the cops do show up at your door you won't even be around. If cops show up and you are in the room at the time, then you would probably get in trouble unless your roomate tells the police you are not guilty and he is the one who was smoking.

yes if you knew they had marijuana in their possession you would be just as responsible as them, also yes there is a test to find THC(marijuana) in your system but if they are smoking in a sealed car(windows up) or in a small dorm room with you then you are breathing it in so the test would still say you had THC in your system and in the eyes of the law you were smoking it
I am not sure what the penalty is where you are but here its a fine and depending on the amount of marijuana possibly a criminal record and community service

Yes It is called association and accessory
A girl in Virginia is in jail for being with some kids that robbed a convenience store and killed the clerk. She had nothing to do with it but she was in the car and couldn't get away when she found out their plans.
If you get a good cop that buys your story they might use their own judgment and let you go but most likely not.
Even if somebody borrowed your car and left it in there and the police found it you would be responsible by law.

marijuana should not be used in a vehicle. Marijuana should not be illegal - it is a represive ignorant law that makes our country no better than the ones that we call dictatorships. Who knows about your question our govt is so screwed up. In some places nothing would happen in others you may go to jail. What state do you live in?

Oh, yes, you certainly will be in trouble. In the first place, if you are in a room where others are smoking MJ, then, you are, too........just by breathing. It's a little as if you asked this: If I am with someone who happens to have a gun, and he robs a store, am I going to get into trouble?..........it's like that. Yes, you will be in trouble if you are with anyone comitting a crime.

In both cases possession is presumed by every one, unless the guilty one steps forward and admits guilt separately.

In the 1st example, they may try to claim that you were smoking too.
In the 2nd example, you should be safe unless they have a trunk full of it.
