I am located in Wisconsin and having a contract dispute with Verizon (based out of New York) . The call center office I get when I call them is located in Illinois.

Questions:
1. Can I legally record my conversations with Verizon employees?
2. Can a company like Verizon (that is operating as a merchant) legally require me to NOT record my conversations with them? I believe privacy laws are intended for private citizens, not merchants.

Wisconsin, New York, and Federal Law only require 1 party consent. Illinois law requires all party consent.

NOTE - I do tell them upfront they are being recorded and they say they do not wish to be recorded. I tell them too bad and keep going, but they don't hang up.

There is nothing in my contract regarding "recording conversations with employees." I am also not going to hire a lawyer for this because the dispute is over $175. I lawyer would charge that in 20 minutes.

1. Not without notifying them you are going to record it.
2. If they do not agree to it, then you cannot. If you noticed that when you call customer service for a company, they tell you that you will be recorded for monitoring purposes only.

Do they make the statement that "this call may be recorded for training purposes" or some such wording? That should probably cover it since you have to inform a person that they are being recorded and they just did it. If they don't - record yourself making the statement while waiting on hold (guess that is border line isn't it). They do business in Wisconsin and are subject to the laws there.
Generally you can record - you just can't use it in court if you didn't inform the other party. But it would give you an accurate record that would be undistorted by your memory.

I would look at your contract. I'll guess that there is a section regarding recording. And I'll guess that they say that you can't. Companies like that typically are very protected when it comes to anything that could potentially be harmful to the company. You could end up being the one that is in trouble. Don't listen to anyone on here. If it is that big of a problem, then contact an attorney. Trying to handle the law on your own is never a good idea. Plus, when different states are involved, you have to make sure it is done right.

Is she recording in basic terms conversations between you and her? Or all your telephone conversations with others? If it is the latter, it is unquestionably unlawful. If it is the former, it must be criminal. Yes, you can. You can either notify them verbally that you are recording the call OR you can have a beep every so often signifying the call is being recorded.

If they object they will have to hang up.

i think since you are talking to someone in Illinois that you would have to go by the laws in that state as well........you would have to let them know you are recording it and i think they would have to agree. not sure, tho, dont come onto Yahoo answers for legal advice.
