Well I just got popped but feel I couldn't avoid it. I was coming up to a stop sign on a steep hill. At the stop sign, there is a 4 way intersection which I was turning left on. Cars were parked on both corners so I couldn't see well. So I busted my left & a car is coming FAST on my butt. So I accelerate. Look in my rear view and here comes the federale. He "gives me a break" & instead of 42 in a 25 gives me a 30 in a 25. Oh thank you officer! It's $117.
I want to fight it since I couldn't stop in the middle of the intersection and had to accelerate to avoid being hit. I've heard of radar guns not being calibrated to manufactuer's specs and people winning because of it. This ticket however doesn't seem to be radar. It says in the Nature of Offense field Speeding and in other field "Robric". Under date equip tested it say 1-4-07 (almost 2 months ago). Is this sufficient to get this dropped? Any other tips on beating this ticket? Thanks!

To the knuckleheads that are trying to give me a morality lesson - keep it to yourself! I don't care what you do-gooders think and could care less about your huffy attitude. Just answer the question that I asked - ways to beat a traffic ticket. I didn't ask if I was at fault or not. Geeeesh!
And to all those that gave me sound advice - thanks! I appreciate it.
Some of you people think that your poopie don't stink. Give it up!

You have a 50/50 chance of beating it.... goto court and tell the judge you had to mnove through the intersection cuz some ****** was riding your bumper and you were afraid he was going to hit you. Good Luck.

Let's see if I have this straight. You couldn't see, so you made a blind left turn into the path of an oncoming vehicle, then to avoid being hit you did 42 in a 25. You don't say if you actually stopped at the stop sign, but the way you worded it I assume you blew that too.
And now, after all that, it's somehow the officer's fault, and you want advice how to fight it. Do I have the facts right here?
And if he read the speed you were going off his calibrated speedometer, and it was tested 2 moths ago, that will be quite accurate since they are typically only tested yearly, and seldom found to be off.
Thank him for dropping it so you didn't get a moving violation for more than 10 over, pay the fine and don't do it again. Or not, you can surely go to court and give a not guilty plea, that is within your rights. But if he had the dash cam on, I doubt you would prevail.

I don't understand why you couldn't stop in the intersection and wait for the oncoming traffic? A guy was coming up behind you fast, so you just punched the pedal and turned? Is that correct? If this is what happened, you don't have a chance at beating the ticket. You always have the option when ticketed to explain to the court the circumstances and why you chose to react as you did. They oftentimes will reduce the fine, because you did speak up for yourself, try it.

You shouldn't have turned if the car was coming. You will not be able to get off on this one. The calibration on the radar gun was recent enough. I believe it is every three months they need to be calibrated.
Even if you got off on the calibration, the officer was driving behind you, so he could have "paced" you which means he figured how fast you were driving because he was driving behind you with no change in distance between you two, hence you two were driving the same speed, hence, he knows how fast you were going.

In Texas, call the court and tell them you want to go to DDC class. Once you go, the ticket is taken off. But it is good only once a year.
Seems you were guilty anyway.

Depends on your area, but usually they arent supposed to write tickets for less than 10 over... go to court and hopefully the judge will throw it out

Just show up and plead your case. The officer might not even show up. They also might cut your fine just for showing up.
