However, I believe at best she should be tried for knowingly lying to the American public, after it had been proven to her and the free world that none of the precepts the Bush administration gave for going to war were true. She had this knowledge before hand, having been in the administration since its inception. The lies the Bush administration knowingly told to Congress is the reason Congress voted to approve the U.N. Resolution.
After becoming aware that there were no WMD; that Hussein was not harboring and did not support any of the 9/11 terrorists; that sanctions were working in Iraq at the time particularly with our planes constantly patrolling the no fly zone; she had a duty to report that to the U.N. and the American people, and she failed to do so.
The issue of following orders that are illegal was resolved following WWII during the Nuremberg trials; that once a person (military or civilian) becomes aware of deeds that are illegal or immoral continuing to be perpetrated on the people of a country by their leaders, that person has the duty to not follow orders
The Nuremberg laws do not exclude the United States.
