i need to know the name of the file that i need to file to have my custody case moved from one state to the other? i have pysical custody but not legal custody and i want joint custody

just wanted to add that i know i have to start were the case was made back in washington state but i live in indiana now with my daughter i need to know what its called when you ask for your case to be transfered? the legal name of witch i file?

If you have physical custody and the Dad is ok with you taking the kids out of state, assuming he is still in the state you moved from, whichever lawyer you had handling your case before should be able to continue with the proceedings from there as long as you and the Dad are in agreement with everything. It doesn't matter if you were never married, whoevers name is on the birth certificate has the same rights, married or not. But even if most of everything is handled through the mail, you may have to go back to Washington State to sign off on the final custodial agreement.

I believe you may be refering to a Motion for Change of Venue
Generally the courts are won't move the case out of the state where the original proceedings were if the child still resides there.

It is better to finish the case before you move. If both of you agree, it will only take one day.

go to your local clerk of court where you filed the original paperwork and tell them what your wanting to do and they can help.
