What are my legal options?
After 31 yrs of marrage my husband walked out. We have a disabled 28 yr. old son and my bed-ridden mother who lives with us.
My husband has been 'PRETENDING' to have Alzheimers so he could retire, not work and force me to get a job. For months he has been PRETENDING he couldnt drive, take his medications or do anything for himself.
I know he has been faking because in the back ground he has been planning his move to Florida to live with a friend. The day he left he had sense enough to pack some items, drive around and try to sell some guns (for money), buy a bus ticket, catch the bus on time and make his way down south.
What do I do now...he said when he was walking out that he would be back to get his things. How do I keep him from being able to walk back in and take whatever he wants.
I would love to get a divorce but every attorney I have talked to this week wants from $500 - $750. I barely have money to live on.
I would love any suggestions...thank you.

You have a couple of options.
First and the best in my opinion is to call a psych ward and tell them he has run off. If the doctors believe he has alzhiemers they lock him up right quick. Second is to try to obtain a restraining order against him stating fear for your life as the reason. In his awkward mental state he threatened to sneak back into the house and kill you. They have to give you a restraining order.

You don't need an attorney for any of this. Call the clerk of court in your city and ask how to obtain a restraining order for domestic violence. They will tell you exactly where to go and who to talk to. It's free, fast and easy. But kind of against the law.

First, I hope that both your son and your mother are getting disability or SSI. Second check your local listings for legal aid. They can point you in the right direction. My divorce was handled through an attorney that I found out about through legal aid. The entire divorce cost me $250. They offer lower fees or possibly free depending upon your circumstance. Also- if you can borrow the money from someone, you can ask for your attorney's fees paid in the divorce. You can change the locks. That would at least slow him down a little. You could also give him 10 days to get his stuff or you are putting it into storage. He will have to pay the bill. I do not envy your situation but you definitely need some sort of legal help. I know that there is also a 1-800-lawyer type hotline that you can call on certain days to ask legal questions. Check your yellow pages. Good Luck!! And good riddance to bad rubbish!!

Depending on how much money you have, you would likely be able to get legal aid, especially since you have to take into account you have your mother and son as dependants on you. Call or go to your local legal aid office.

Is he drawing on a pension or diability benefits? If he has any steady source of income he would likely have to pay you support for your son, as he is not able to provide himself with the necessities of life.

It would likely be a lenghty and difficult process to prove that he does not have Alzheimers, but it may be worth it as he may be able to go after you for alimony if the case is that he cannot work.

You seriously need a lawyer for this sticky situation and to ensure the livlihood of yourself and your son.

If legal aid cannot assist, ask the lawyer you spoke to if he would take a series of postdated $100.00 cheques. Lots of them will they just don't advertise it.

Sorry for your dilemma, but you wont find any real help here....You need an attorney..plain and simple. Legal Help might be a good start. Check with your local Legal Assistance Group

yo momma freeloads in a nursing home at the expense of the government. the kid goes on social security too. he can freeload too. it is more lucrative and fulfilling to work than to collect welfare than to freeload off the system. s-hit, god damn, get off your *** and jam
