is anyone awaer of an employer stoping staff smoking but allowing visitors to smoke if any one is aware of this and if a case has been before the courts and won please let me know and teh case it won under wether human rights' ?? hope u can help

ps i am a none smoker before u ask

Smoking is lawful but taking away the right to smoke is unlawful. In my town/county, there is a no smoking in businesses unless it's a bar who make at least 80% of their profits from the sale of alcohol. This is not only bias but un lawful. Telling me what I can and can't do in my own business is nothing short of Nazism.

A UK employer can and indeed must not allow employees to smoke in the building. There is no jurisdiction yet for visitors but I am sure there soon will be

In New York State all smoking is banned from the workplace. Laws in other states may differ. You need to contact someone in your jurisdiction to help you out with this one.

Visitors or not it should be stopped as it is Passive and can do harm to others.
