inherited have not been "cashed in" by a fellow executor of a will? The fellow in question says they were cashed, but I dont think they were

you say this person is a fellow executor from which I infer that you are an executor as well: therefore you have an equal right to see the documents and sign the transactions. However, the executor is also responsible for providing a statement of assets to produce for the Inland Revenue (if there is an inheritance tax issue) but also in order to obtain a Grant of Probate. I would ask to see this. Alternatively, if you know what shares they were, then you could find out the company's registrar and write to them and ask for these details, informing them that you are an executor of the will, and they will respond either telling you that the shares exist or that they were cashed.
If you are both executors, however, then there's obviously some communication difficulties between you. You should BOTH be signing all documents, sales of shares, enquiries for information, etc., Why do you think this guy is doing it on his own, without you?
