Ok I have a question recently my friend was caught taking water and coke from the store. It was accidental she truly did forget it was on the bottom of the cart she spent 130 dollars in grocerys and forgot those 2 things... well now shes going to court on petit larceny charges... she wants to plea not guilty but shes worried about something... about 2 months previous she truly did take a bottle of advil and they never caught her... is it possible that they can go back into old tapes and find out she took the advil and charge her for that to or do they have to catch you at the time? please help me shes so worried! thanks so much

Don't worry about the advil!!

That is not realivant to this case.

what store and state are/where you in?
are you allowed to have a lawyer present?
Do pleed not guilty!
it's the check out person's job to ring up your items.
if you did self check out, ask to meet with the reginal manager,
and pay them restitution.

This is the checkers/clerks responsiblity to ring up your order of water and soda on bottom of cart?

Or did she go thru the self check out and forget to ring it up?

To me this seems like a clear case of she paid what she was charged for, and didn't check the reciept and if the clerk didn't ring it up, how was she to know???

Has she offered to settle out of court?
to pay for the soda and water?

Has she exhausted all means of talking to the store manager, Area Rep Manager??
is this in the USA???

This has happened to me, they have forgotten to charge me for what's on the bottom of the cart.
I always, always ask for help out to the car, and I do not push the cart.

It is not until I get home, and read the check out ticker that I see if I have or have not been charged.

when i've gone back to the store to pay, they just give me another case of soda or water. they don't understand.

In your case, I would just see if "your friend" could settle this out of court. AND promise to never shop there again.

sounds like the check out clerk and her both made an honest mistake!

Forget the advil!!
they would have already gotten her on it.
Don't bring it up, unless you settle out of court, and say, by the way, I owe you $--.xx more due to the fact that there was no charge for the advil either.

Don't admitt guilt.
If this was self check-out----- you are quilty
if was the clerk who didn't ring up the sodas/waters-- clerks mistake-- but still not your right to freedom.

Try and talk to Regional manager and settle this one out of court.
If all else fails, get the media involved over such a petty thing!!

sheesh, the checker could be the one who was too lazy to ring it up, and the customer would never know-- not my fault.

but if self check-out, go back and offer to pay. and never return to the store. *black list yourself from that store* as an offer of good will.

they don't want to lose customers, but they don't want people not paying for items either.

GET your local news involved, and don't worry about the Advil.

Tell your "friend" to not take things from stores she cannot pay for!

Your friend has broken the law knowingly and should be prosecuted for the crime. Her guilt has prevailed in this matter. The store does not keep records of theft per say, most video monitoring systems are in place to deter armed robbery or physical threats to staff. Found guilty of Petty larceny for the oversight might set your friend straight. She admitted theft of the bottle of Advil to you. My advice is that she should take a couple of them to alleviate the predicament she is in now. Do not steal. It is not right. Good luck to both of you, and be honest.

It is possible but highly doubtfull seeing as they dont know she took it and arent going to review thousands of hours of tape over water and coke which I can believe is going to court on anyway she will get off if this story is true but it sounds fishy,I think she steals alot and they have alot more on film then she is leading on.

So they caught her when she diddn't mean to, but she meant to at a different time. Take what she has coming to her. It's petty larceny anyways. It's one your record, but it's not a major offense. She should pay. I could answer your question, but won't.
