It wasn't discovered, it's questionable whether anyone could reasonably claim to have invented it. The first data structures were hand built in machine coded software, there wasn't any language support for it.

I wouldn't be surprised if there's a patent for it, there are patents for many things that people were doing for years without giving them a name.
