My friends Mom is going to call CPS soon.
Because my "dad" is a meth head and there was alot of mental and physical abuse going on. I'm pretty sure he will go to jail ecspecially if they find his stash and so will my Mom because she witnessed all of this and did nothing so she is just as guilty.
I am 15 going to be 16 in a few months.
I'm getting a job right now.
So is my twin sister. we would live together.
We also go to Independent Study so we can graduate early.
Do you think we could get emancipated?

It depends on the state you live in, but yes, it sounds like good grounds for emancipation if you and your sister will have enough money to cover ALL living expenses, including rent, medical care, food, clothing, utilities, etc. Emancipation in real life, however, is a long, drawn out process. It can take more than a year for the paperwork to go through. That, obviously, makes emancipation worthless. Depending on what state you live in, some lawyers advise that you just move out and live on your own (when you turn 16), but it depends if the laws in your state allow you to live on your own.
The main problem with moving out and not being emancipated is that you will have difficulty obtaining medical care without parental consent unless it is a life or death situation. You can usually get sexual healthcare (birth control, etc), but other types of health care is difficult to obtain if you live in a state like Florida, for example. Also, your parents can cancel your learner's permit onc eyou move out. If that happens, you won't be able to get a driver's license (unless your parents allow you to), so you'd have to wait until you are 18 to get even a learner's permit.

It sounds to me like you have a good chance. You have circumstances that make living under your parent's 'rule' intolerable, and you can show the judge that you are responsible because you are getting a job and taking independent study classes, which take a lot of discipline. It would be a long process, probably, but you could do it. Whether you should or not is another question, and one that I can't answer.

Hi, I have done a lot of research on this and it sounds to me from you saying you are going to independent studies and getting a job and all, yes you have a great chance of getting emancioated. One factor is i was told you have to wait till your at least 16. You have to prove you have a stable house to live in, even if it is with your sister, you have to prove that you have transportationa and a steady job. Other than that, i wish you luck.

Emancipation is difficult to obtain without definite proof of negligence. If you have another relative that will take you in go that way first. If not you can petition the court for emancipation.

not to disappoint you but i was told at least for in missouri that your parents have to agree to it or something like that. the only reason i was emancipated at 17 was because i was pregnant but i wish you the best of luck, and hope you are able to get out of that situation one way or another. thats not a good way to live. if you ever want to talk you can im me or something.

If CPS is called, I highly doubt you would be able to get Amancipated. When CPS is called, you will most likely be put into a group home for a while until they find you a foster home. Then from there you could skip form foster home to foster home until you are 18.

In a court of law, as long as you can prove that you can take care of yourself, better than your parents can. you will have to prove this though, so if this is something your going to try, start taking notes now.
