My friends Mom is going to call CPS soon.
Because my "dad" is a meth head and there was alot of mental and physical abuse going on. I'm pretty sure he will go to jail ecspecially if they find his stash and so will my Mom because she witnessed all of this and did nothing so she is just as guilty.
I am 15 going to be 16 in a few months.
I'm getting a job right now.
So is my twin sister. we would live together.
We also go to Independent Study so we can graduate early.
Do you think we could get emancipated?

Emancipation laws vary from state to state and province to province. The helpline can assist you to get all the info you need. Meth can be traced without finding the stash. You deserve better. Your mother is likely torn, fearful and feeling helpless especially if she is on the receiving end of some of that abuse. I would say this is true even if she does her share of the fighting. There is a whole psychology around battering and drug abuse.

I wouldn't recommend it. You would have to pay your own rent, food, transportation, utilities, etc. And no job a 16 yr old could do would cover all that. Your education should come first, and your best route to a somewhat normal life is to find a family that can manage the money stuff and leave you two to take care of your education-- without worrying about ending up homeless or on welfare for the rest of your lives. Find a way to leave your home mess behind you, and make sure you and your sister can learn to live the right way by seeking a good example in a loving foster home or in the home of a trusted relative.

Absolutely - it sounds like you would have grounds for emancipation. You will need to get a lawyer, depending on where you live, you may qualify for legal assistance. You will be made a ward of the court during the proceedings and you and your sister may have to spend some time in a foster home. I'm sorry that you feel so desperate that you need to separate your self from your parents. Just learn from their mistakes - finish school, go to college and stay away from drugs or anyone even remotely associated to them. Good luck.

If you and sister were just a few years older, it might be possible. Mainly, the process of emancipation is to petition the court, and prove that you are mature enough to provide for yourself fully.
The function of cps is to provide for a safe place for kids, so they DON'T have to be shoved out there as an adult, before they are prepared.
It does not seem likely for you and sister. I am so sorry for the choices your parents are making. Losing custody may be what they need, in order to get their crap together.

No I don't think you could meet the requirements! Some states don't have an emancipation law, like mine!

I suspect you would be placed with a relative!

But you never know these days! Children just turning 16 dont have the maturity level to make it on their own!

absolutely, you can (the details will be dependent on your state). i was emancipated at 16 ... but, i had my parents' consent and had already graduated. i don't know what measures you'd have to take to get emancipated with parents in jail. will you be able to graduate before they go to jail? because, you won't be able to survive on part-time pay, so you might want to wait till you do... just stay with another family member or something. if you're close to graduation, you can start the paperwork now, because it will take a little while for it to go thru. good luck.

Do you have any family around? I think it would be better to go live with your grandparents or aunt or uncle for a couple of years than trying to make it completely on your own.
