I heard it's already too hard to get people to shovel. This is just one more excuse.

The myth is busted. People who walk in winter conditions should know the risks of ice and other problems of the season. You can be sued just as easily if the person trips over something burried by the snow.

Your responsiblity is to warn people of uneven sidewalks, clear the sidewalks and put down some sand or salt to prevent slipping on the ice. Read your lease agreement for maintance issues for common areas, such as sidewalks. If you own the property, consult city ordinances about clearing sidewalks. You might not own the sidewalk, but you do own the responsiblity.

Even if they try to sue you because you altered the conditions on the pavement, the city is to blame if the have an ordinance requiring snow removal. If you follow the letter of the law, and can prove it, then the responsiblity falls on the city.

It has happened when a company or business did not shovel the peice of sidewalk infront of their business and someone has slipped and fallen and they were sued. It actually happend to my Oma. She was walking out the back door to her office at a Realtor and she slipped on ice that was outside the door. She could have sued the persons responsible for not shoveling/plowing But i dont think u are liable if it infront of your home but I've heard of cities making people responsible for shoveling the sidewalk infront of their homes so u never know

Here in New York City, if you DON'T shovel the snow off your sidewalk your friendly neighborhood Sanitation Enforcement Agent will write you a big fat ticket! So you'd better shovel your sidewalk - or you'll owe Mike Bloomberg $ 100 bucks!!!

My understanding is that your liability increases if you shovel the sidewalk. The sidewalk is city property, and snow is a natural occurrence. However, if you alter the condition of the sidewalk, and somebody falls on it, you are liable for the change that you made to the sidewalk.

NO but if you are too lazy to shovel your sidewalk, and I slip and fall because your sidewalk is filled with ice and snow...then you deserve to get your *** kicked...or sued.

Where do our elderly people walk in the street, because your side walk is not cleared. I cannot imagine someone who made the attempt to shovel getting sued......but if you don't you deserve it.
