my sister file her taxes through tur-bo tax she waited three weeks for a refund then in the fouth week they told her she did not have a record where she file in 95 or 96 can the irs go back that far can they hold her refund

It was probably 05 and 06 (IRS goes back 3 years).

Normally the IRS only looks back up to 5 years. However if tax fraud or tax evasion is suspected, there is no statute of limitations and they can go back decades if they choose to do so.

The 5-year rule is from the filing deadline or the date the return was actually filed, whichever is later. Therefore any year where a return has not been filed is still considered open and the 5-year clock hasn't even started running yet. If the IRS has information that indicates that there is tax due from 12 years ago, they certainly will pursue the issue. The IRS will file a "constructive return" and assess tax based on the information that they have available to them. The only way to stop that is to file a legal return for the year(s) in question and pay any tax due. If there is a refund due it is lost forver for any tax year prior to 2003. The 3-year rule is for claiming refunds.

They could if she was supposed to file and didn't file a return at all, but probably wouldn't go back that far unless they'd already been looking at those years and had already been in contact with her.
