There are a couple of ways to not end up with a patent. One is by contract with the company you work for. most companies have it under contract that anything you invent while in their employment is theirs to own. This is going by the pretense that if you did not have the facilities that they provide you would have never invented what you did. Their are a lot of engineers who lose their patents this way, but most do not mind because they are compensated really well by the companies they work for, plus they will sit on their best ideas untill they can afford to quit and patent it on their own.

The other way is to have someone else beat you to making the patent. Such as there was another fellow who invented the lightbulb as well, but since Edison patented it, he is credited.
