Its most definitely a misdemeanor. Depending on your city or state ordinance you can be charged with a felony depending on how many knock-offs you try to hock. Many brand name companies retain a full time legal staff to pursue such charges. Go the the library and check out your municipal code book or state criminal law manual for more info. Yes, the police have bigger fish to fry and just because other people do it and get away with it doesn't make it legal.

if the knockoff looks exactly like the real ones, then yes it is actually very illegal. if there is a slight difference in the letters or crown or something, then no. its just like buying pirated dvds are illegal too. i've been to NYC and, it is always on the news that if you are buying/selling knockoffs (fake imitations), then you are violating the law. many people misunderstand that this is a very serious crime. and also, just so you know, in nyc, the people that sell these knock offs, have them lined out on the ground on sheets for people to look at when the walk by. they do that because when they see a cop, its really easy to just grab all four ends of the sheets so that they can run with it. them running when they see a cop is also a for sure sign that it is illegal.. but you won't go to jail or anything if you bought one. the sellers are the people who would get in trouble.

Yes it is. IF it violates trademark laws- meaning it has the same markings as the original. I used to have a shop at a local flea market and they have came a few times and took the peoples items and they had huge fines to pay. It doesn't matter if you say it's real or not. If it has another companies logo and design that can trick people in to thinking it may be real and it is not made by that company it is illegal.

no its not, people do it all the time, in the malls. If you are selling them for 20 when the y cost over a hundred everyone knows they are knock offs and noone cares. People buy them all the time.

I don't know. It should be if you are selling them as "authentic". I went to a few purse parties and bought quite a lot of stuff I thought was authentic and it turns out it's not. I am pretty upset since I spent over $500 and then find out it's fake. :(

of course it is. Why do you think most name brand bags have a registered or copyright by their name. IF you buy a knock off bag it is as if you were stealing from the original maker.

It's a really grey area. If it looks enough like the original, then you can be sued. If it's clearly not, or if you have a big disclaimer on there, then you're probably all right.
Certainly, if you try to tell people it's designer when it's not, then it is!!
