some of the people in the 300mm plant were given a severance package if they signed a no sue agreement. At least one IBM manager told the employees the taxes taken out would be 'gotten back'?????? inflating the amount unrealistically... is it ethical for a manager to bait someone to sign a no sue package by misrepresenting that severance is higher claiming the taxes would be returned...
why would severance income be 'returned' for someone who has to get another job??? Is IBM management ethics scraping the barrel in the hudson valley.?

No, under the circumstances you describe they can't. That's misrepresentation and you may have a Tort claim, as well as a possible Contract claim against them. I suggest you speak with an attorney.

severance pay is not neccessarily taxed at the normal rate. You should consult a tax accountant about calculating your taxes due.

Misleading claims may void any severance agreement.

Any income is taxed, including severance packages. Why wouldn't anybody ask just how these taxes would be 'returned'?

Certainly not. Ethical, however, usually takes a backseat to profitable.
