My daughter's biological dad after her birth, quit working to go to school so child support was set at a minimum. He was negligent for the first 4 years of her life and after they raised child support, he then started seeing his daughter. I was able to obtain full physical custody of my daughter due to her dad's negligence. He lost his job 4 months ago so I was then receiving a min. in child support and now that he has a job again, child support has been raised and now he is mad about that so he claims he is going to take me back to court to try to obtain more custody to get his child support reduced. She is 7 and I don't talk to him which he is upset about, but he gets to see his daughter whenever he wants to. He picked up my daughter today and complained to my mom about how much he has to pay in child support to me and that he was going to take me back to court. When I have talked to him, he calls me a stupid waitress. What can I do? I am back in school, made deans list. Not stupid.

yes he can,but that don't mean he will win. try to get along better for the childs sake.

"Not stupid." A definition of stupid is doing the same thing over and over again while expecting different results. If you just want people to agree with you or to post a specific reply, then tell them so in your question.

He can fight for custody. Will he win? No. He seems too unstable and you have had custody of her for 7 years. Courts almost always favor the mother. That doesn't mean he still can't see her if he's paying anything.

I can certainly understand why you don't want to talk to him! He can certainly try to do anything he wants, but with any luck the judge will see through his ploy, which is evil! And even if he has your daughter for more of the time, you still need to provide a roof over her head, so he shouldn't be paying much less even if he has her more! It's despicable that he is badmouthing you to your mother.. I hope it wasn't in front of your daughter! I hope you're taking the high road and not doing the same thing.. even if he is a bum, he's still your daughter's father.

Long story short:as long as he has the funds to pay a lawyer to represent him, he CAN file for custody.The question is, will he win?With his history of neglect its highly doubtful he'd get sole custody, he MAY get court ordered supervised visits however. He feels he has to call you nasty names because he was proven inadequate as a parent, just a man playing childish games to make you feel as low and powerless as he does.You have my sympathies I went through similar things for years, my suggestion to you is to doccument everything and just try to stay sane. I know it will be a hard road, but stay strong, remember you're fighting for the well being of your child.

Anyone can "fight" for anything in the courts. That does not mean that they will win.
