My brother and his wife just recently broke up due to infidelilty on both their parts. He got both his wife and another woman pregnant and decided he wanted to get a vasectomy (no more 'oops' babies) so he scheduled an appointment, went to the doctor, told him he wanted a vasectomy...and the doctor refused. Told my brother that while he was still married his soon-to-be ex-wife had to sign off on the procedure before he could do it. Is this legal?

Tell him to get a different doctor. This doctor is being a jerk.

Your brother could try to sue him, but of he did he would be no better than the doctor. Being a doctor is a business. Everyone has the right to refuse a customer if they please.

The doctor is only refusing your brother because of liability. If the doctor feels your brother may change his mind, then he could sue the doctor for not warning him that a vasectomy is permanent.

I have no kids, but had a vasectomy 20 years ago. I went to three doctors before I found one that would help me. He never even asked if I was married, or if I had kids.

I lied and told him I had one, even though he never asked. You brother should claim that he has two healthy babies and is happily married. He might want to lie about his age as well.

He should go to a different doctor, I have never heard of that. Women kill babies by abortion and not tell their husband or boyfriends, what is the difference? Talk about hypocrisy. Tell him to go to another doctor, please!!!!

I do have to add though that there is a big difference, a vasectomy prevents a pregnancy (as least the majority of the time), an abortion kills a living viable human being.

Absolutely correct. Just like she couldn't have a tubal ligation without his signing off. It is part of the marital contract.

He should just either keep it zipped up or wrap it - and BABIES ARE NOT OOPS!!!!, as I'm sure he will find out when he gets hit for child support.....

He can always go to another doctor. I wouldn't want to force a doctor that didn't want to do the procedure to snip my sack. I would much rather find someone who agrees up front.

I don't know if it's legal in your state, but in CA a wife's consent is not necessary. My husband got one and I didn't sign anything. Tell your brother to go to another doctor.

I HOPE HE'S PLANNING TO PAY SUPPORT FOR ALL THOSE BABIES!!!

It is legal for a doctor to refuse to perform any non-emergency procedure, and for any reason.

it is not in ohio,but other states may be different. tell him to go to a different doctor. check this,just change location
