I just recieved finalized divorce papers in the mail. The other party is responsible for 57% traveling costs. We live about 95 miles apart. I have to pick up and drop off the kids. So does that mean he has to pay my gas, and if so, how do I calculate that? I've asked the courts, but they say they can't help me. Any help would be greatly appreciated.

The legal definition of mileage is 44.5 cents per mile. NOT the cost of gas.

Keep a ledger of your mileage to and from picking up the kids.

95 miles round trip is 190 miles. 190 x 44.5 = 84.55

84.55 x 57% = $48.19. So each time you take or pick up kids he owes you $48.19

Hi there. Looks like you got yourself in a pickle. So, first fill your tank full and put your odometer to zero. Figure out how many miles to the gallon you get on your car. Let's say you have a 12 gallon tank and when your full tank is empty, and the odometer reads 200 miles. 200 divided by 12 equals 16.6 miles to the gallon. So 95 miles at 16.6 miles to the gallon equals 5.7 gallons used. Let's say gas costs 2.20 a gallon then multiply this by 5.7 which equals $12.54 is your total cost one way. Now double this because you have to go round trip. So $12.54 times 2 equals $25.08 . Now multiply 25.08 by 0.57 this gives you $14.29 which is 57% that he owes you. You need to figure out your gas mileage first. This is just an example.Record all your odometer readings and dates and keep gas receipts when you must do these trips Too bad both of you settled on this mess. Good luck. Have a great year. Most divorce settlements make the man pay and pick up his children not the ex wife. I'm surprised you agreed to this. Sorry for your troubles.

It varies what is considered traveling costs. Some say it covers gas and mileage, some say only mileage, at a certain amount per mile. To calculate 57%, multiply the miles or gas amount times .43 on a calculator. That would be your portion. You may have to ask a lawyer what constitutes travel costs.

Take the round trip mileage (95 miles x2 or 190 miles) and multiply it by the IRS mileage rate which is I think 44.5 cents. Then, take that times 57%. That's what the other party owes you for each visit.

95 x 4 (go to his house drop off kids then back to your house, and then back to his house pick the kids and back to your house) = 380 miles. find out what's you mileage...for example your car spends 20 miles per gallon, divide 380 by 20 = 19 gallons. let's say the cost of gas is $ 2.75 per gallon, so you would pay a total of $ 52.25 for these 380 miles. He would pay $29.78 ($52.25 x 0.57, which is 57%).

another option is to fill up your tank and then mulitply the total by 0.57, then he would pay that 57%.

Keep an accurate record of the cost of your gas, then with the total cost, use this formula;
The total $ of the gas multiplied (on a calculator) by 57%.
If it was $30, take 30x57%, which equals 17.1, so he would owe you $17.10 in gas money.

First you have to keep trak of your traveling cost so you have a dollar amount. Then input that cost in a calculator and multiply by 0.57

That will give you the exact figure.
Example: Traveling cost = $3500
3500 x 0.57 = 1995
57% of $3500 is $1995

57% means if you pay $100 for gas, he would have to repay you $100 x 0.57 = $57.00

why wouldnt 1/2(50%) satisfy you?you will be at your calculator,rounding up,etc..and you may even short-change yourself.give him the 7% break...he may even roud-uo your expense..eg if the cost(to him) was $43,he may let you have $50.
