Anyone know what the punishment is in Virginia for driving without a license, my friend got caught and he has a court date coming up.. its his first offense ? I know what the websites say its class 2 misd. but wanted to know if anyone has got caught driving with no license and what punishment they got.

There are a lot of factors to consider. Where in Virginia did this happen? Is he a local? Was it a local cop or highway patrol that gave him the ticket? Is he underage or had his license revoked, or has he just never had a license? Who's car was it and would their insurance have covered if he was involved in an accident?

Remember Judges hand down the sentencing and from my own experiences in Virginia, if you're not local they don't give a crap how bad they screw you. He'll have a chance to present any mitigating circumstances (basically a defense) for instance "I just found out my mom went to the hospital and had to get there. I know it was wrong, but I just couldn't stay home and wait" will have a better impact than "the keys were there and I got bored."

If its his first offense he can speak to the DA or Judge about a PJC (Prayer for Judgment Continuance). Basically, this is a get out of jail free card. If he's granted this, he can't get into any trouble for a year (no speeding tickets or anything) or it'll come back. If he stays out of trouble, it gets dismissed.

i'm not from there but if your friend can get a license he should start that process so when he sees the judge it would look like he trying to rehab himself. Brownie points especially since it is their first offense. They may just give he a fine and once he get the license he will have points on his record.

Fines ...Community service....No license 4 another 3 months.

Most likely if it is his first time and he was not under influence and nobody was hurt. His licence will be suspended...Mary.
