My 15 year old son works part time at a funeral home after school. He washes the windows, vacuums, dusts, etc… Yesterday my son another young employee decided to start fooling around and in a moment of non-brilliance, my son got inside one of the showroom coffins.

The other boy shuts the top and cranks the air tight seal closed. From what I understand now, these coffins do not "re-open", once sealed that is it. Anyway between my son scratching, clawing, kicking the inside of the coffin and the boy on the outside using screwdrivers, sledgehammer & crowbar to pry open the coffin it is completely destroyed.

The parlor owner now want the other boy's parents and myself to pay for this $7,000 coffin.

Doesn't the funeral parlor have insurance for such damage?

Had they not destroyed the coffin my son would have suffocated in there.

Ya, this story is completely false and untrue, caskets most definitely can be opened again after they are closed. You simply have to unscrew the seal and the casket will open once again. So please, quit telling stories for attention. And no, insurance companies do not insure stupidity.

Yes, the parlor has insurance for the claim even if the boys were foolish. That is what insurance is for. We own a roofing company and have paid medical bills for one kid shooting the other in the eye with a nail gun. We also, paid for a kid that cut his leg while making his jeans into shorts with an utility knife. Stupid or not it happened while he was on the clock. The owner just doesn't want to file the claim and have the possibility of the insurance going up, which I doubt it would. That coffin probably isn't worth $7,000 . Probably the retail price. Other option-- make the kids work it off even if it takes untill their out of high school. Good luck!!!!

You might not want to hear this, but your son was retarded and shouldn't have been messing around with a CASKET. It's a casket people, its not a TOY, its what DEAD people are put into. What ever happened to owning up for your mistakes and not always trying to pass the buck? He is under 18 and he is your responsibility, so yes, I think you should have to pay. Why should the funeral home be out the insurance deductible to pay for your son's negligence? Even if you take this to court (small claims or not), I don't see how you can get out of this. Your son was in the wrong and should pay because if he had been doing just his job, the casket would never have been destroyed. I'd personally think he should be the one to have to pay if off ... but then again I wonder what in the world a young kid his age is doing working in a FUNERAL HOME ... but that's just me, like I said, you probably don't like my answer, but this country needs more personal responsibility.

That's so ridiculous! They should have some sort of insurance policy that would cover it and I'm sure they do. More than likely, they just don't want to have to deal with making a claim and or paying some sort of out of pocket deductable. Kids will be kids and that's a risk they took upon hiring your son and the other kid. The kids were their employees so the funeral home could be held just as responsible. They would never win if it were to go to court, mainly because the other kid sealed your son in. If it were to fall on anybody it would be him and his parents. Luckily your son is ok and that's the most important thing of the situation.

Sounds like the kids are stupid, but then I remember my youth! :)
Seriously, the way law suits seem to drive our society, think about telling the funeral parlor you will pursue them for having an 'attractive nuisance' (like a swimming pool without a fence around it) in an 'unsupervised' work area where MINORS are expected to work. Also, I doubt the casket would cost the parlor anywhere near the $7000 price tag to replace it.

The funeral parlor guys have no legal recourse, because 15 year olds cannot be bound by contract. They took a risk hiring kids, and this is why it's a risk.

DON'T PAY.

I can understand your problem but your son IS 15 years old, he should not have been fooling around, of course he will tell you HIS side of the story, but you might want to know what might have really happened, it is too bad, its not something that should have happened to you, and the Wrestling Forum is not the place for this question, sorry...

Well I hope the two young lads have learned a lesson. But to answer your question, the funeral home should have insurance, if they don't they don't need to be in business. In the big scheme of things $7,000.00 for them is small potatos

i dont think anyone should pay, unless the funeral told these boys and other workers that the coffins do not open back up. If they didnt tell them that, they are not at fault.
