I took my car into Aamco in Texas to have a vibration that happened when making a turn from a stopped position looked at. After telling me they weren't sure what it was but, having had another mechanic look at it they thought that it could be my rack and pinion. They charged me 900 and said it was fixed after a bunch of other BS. Long story short, the noise is worse and sounds really bad. When we called the owner to ask what he would do about it he basically said it was our problem and he would charge us to fix the differential, which was the problem to begin with. Can I take him to court? Will I win?

Well, first I would call the better business bureau and file a complaint. Then call a lawyer and discuss this exactly to him. Just remember if these people gave you an estimate to do said repairs and you authorized them repairs based on them telling you it needed it (which it still may have needed regardless) then you might not get very far.I suggest you ask the repair shop for the old parts they took off, so you can have them inspected by someone to see as to what the condition was. Also wouldn't hurt to take your car to someone else to check and see if that said work was really even done to begin with.If not, then you for sure have a case.

Most chain repair shops like Aamco guarantee their work for at least 90 days, so if you're still within the warranty period then take it back and demand that they fix it properly, and make it clear to them that you're not paying one more dime for them to fix it because you took their first estimate on good faith, so you expect them to make it right. If they give you a hard time, file a complaint with the Better Business Bureau and take them to court. Be sure to sue them for the cost of repairs, all court and legal fees, damages (not being able to drive the car and the cost of a rental car, if you need to get one) and throw in an additional $500.00 or so for inconvenience expenses (the time and effort you spent taking them to court).

if you can prove the problem is now fixed and it is the same concern in which you paid 900 previously' file a small claims suit at your local jp court' and you will win at least half the amount if not all' but keep in mind the court wont award you money for mental anguish or anything but when the repair shop gets served the court documents they will most likely want to settle with you for some amount to keep from going to court.

Contact your local Attorney General Office.
Also, make a report to the BBB.
This is just bad business practice, and if you see this all the way through, you'll be ok.
