I own a business and pay my "employees" as 1099'd contractors. I recently found out that one of my employees was collecting Unemployment benefits at the same time he was collecting income from me. Am I liable for his actions? A fellow from dept of labor just called about an audit.

It seems to me like he would be responsible for this fraud. It just makes me nervous that the gov is looking for my records.

They're looking at your records to find out information about the employee. You're not responsible for his fraud.

The only thing the auditor should want to know is the hours and weekly gross pay of that employee for each week he fraudulantly claimed unemployment while he was working for you. It's his fraud not yours.

Hes the one in trouble , he shouldnt have been able to collect on you without you knowing it

shouldn't b your problem. but you seem nervous about someone looking at your records in the first place. what do you have to do hide huh?

His problem, not yours. Once your caught commiting fraud with unployment, your not eligiable for it anymore....at least in MI.
