This guy is not on the birthcertificate, he goes to jail often for nonpayment of childsupport on 3 other children all diffrent mothers. He told women that he was fixed. Appearently he never was fixed.

What do I do!?!

no father is named on the birth cert.
We are going to court for paternity, but what will happen if she is not mine? Will they take her away from me and my other daughter(her big sis)?

If you were married at the time of the child's birth and your name is on the birth certificate then you are legally responsible for that child. Also if the child has always been with you in the home they are not going to give this other man any rights even if he is the sperm doner given his past history and the fact that he has 3 other children that he dosen't care for. Also this guy may just be trying to tarnish the memory of your late wife. I say ignore him and act like he never existed.

Are you listed as the father on the birth certificate? He will have to prove he is the father since he is not listed on the birth certificate, tell him if really feels he is the father that he will have to prove it. Unless he takes you to court to establish paternity and a paternity test proves he is the father, he will have no rights to the child.

Force a paternity test. Since he's not on the birth certificate, the Court would not hesitate to order the test.

You do nothing. If your name is on the birth certificate, it is up to him to provide the burden of proof. He is the one to initiate and pay for DNA testing. If it proves that he is the father, then you might need a lawyer. Until he requests the DNA testing, it doesn't matter what he says, he has no rights.

Get a DNA test - that will solve the problem right away. Get a lawyer and have him put together the papers and whatnot through the courts. If he wants to claim the child IS his, then he has to prove it.

If I was you I would go right away and get a DNA test done. and don't let this guy that you know is not father material come and try to take your kid away you already knows that he dont take care of his other kids so dont let him come and just be a part time no good *** father to your baby.And if you love this child and loved her mother you will do whatever you can to make sure that she stays with you. so go and get that DNA done right away, do not just take his word. GOOD LUCK and I will keep you and your family in my prayers.

Just protect yourself and your child~start off with an attorney, and a paternity test~no matter the results, it is better off to know the truth...EVEN IF your daughter is indeed his, you are still the custodial parent and you have rights that will protect you.

If he continues to insist he is the father, request a DNA test. Let the DNA test determine the truth.

The guy sounds irresponsible. If he is not paying for the other three kids do you really think he wants yours? Wait and see his next move before waisting a bunch of money on an attorney.
