my sisters check is getting witheld because she quit her job and they say the reason they are holding it is because she owes in et time she earned but never used. and if they cant what should she do?

It is illegal to hold someone's paycheck for any reason. A paycheck covers the time that you have ALREADY WORKED, not time you are scheduled to work. Once you have done the work, you are REQUIRED to be paid.

Your sister's former company is breaking the law. Have her call the police.

Depends on the state. Generally, it is illegal to hold a paycheck, unless wages are garnished.

Labor relations board or a good labor attorney will help.

I don't think they could but I would advise her to check with the Labor Board in her state. The laws vary from state to state.
