Before I got married last year, I was already holding a B1/B2 Visa.My husband did not sponsor me nor make any change for my visa status (although he is a citizen, he lacks some legal papers to sponsor me) and now we are in the verge of divorce. I wanted to stay married and hoped for a complete family, but I cant stay married with someone who is abusive in many ways. My children from my previous marriage are here studying and I dont want to abruptly stop them from finishing their studies. The school day ends in May 2007. Any suggestions?

If your husband did not sponsor you and he does not affect your visa status, chances are you can stay. I would consult a good immigration attorney to find out for sure. If you are married to a citizen it usually takes only 6 months to complete the visa process.

All answers you get are guesses or sharing of information under similar circumstances but not identical ones. Each case is different.

I can share what I know:

Your husband has to cooperate to say that he is married to you when you apply for a visa status which will speed up the process. If he is abusive as you say, he may use that as a means to abuse you even further. So he may threaten you and refuse to cooperate.

If he refuses, you can go it alone but your attorney should take up this matter with the authorities. It may drag on for months.

You will get a temporary stay. After you get a decision, hopefully in your favor, you should feel settled in your mind.

There is a distinct possibility you will get the green card but the authorities might initially view this as a "marriage of convenience" just to get the visa. You have to prove to them that you are genuinely in trouble.
