As the mother, she would have custody. However, there would still be a paternity suit, as it appears that Howard K. Stern is determined to be recognized as the father, and so is Larry Birkhead. I still think that Larry Birkhead is the father, and he would still be seeking to be recognized as the father if Anna Nicole Smith was alive.

Yes. Im sorry fellow repliers but Larry Birkhead wanted a paternity test a while back and Anna was trying to avoid the Paternity test - it was really gonna get ugly whether she was dead or alive- but with her having interviews all drugged up I think their would have been a fight about who was keeping the baby cause she looked negligent-Im sure people observed how she was acting in those last interview and probably said "she cant take care of a baby in these drugged up conditions." she looked sleep in alot of the interviews.Besides, This family like drama-it excites them so Problems About Who Keeps Dannielynn would have occured-they were gonna occur. trust me. Now whether Larry wouldve had a chance to get full custody while Anna was alive is another issue.

No. Before Anna died I think they were only dealing with the paternity test. Anna would have been the legal guardian. She is the mother unless Larry wanted to fight her for custody but we don't know who the father is.

I think you worded your question wrong 'cause if she was alive then the trail would not have happened. I do feel sorry for that baby though because her Mom was a drughead, her brother died, & now her Mom is gone. And she will growup quick & always in the spotlight. If no one helps her & raises her correctly, then she won't have a decent life. She will end up like her mother.

yes her problems that were to come with the custody of her child were too much for her to bear. the government and child protective services were waitng in the wings to snatch her baby. she was already being portrayed as unstable and a beautiful blonde haired baby is most desirable to the billion dollar baby trade. did you know the u.s government sells babies via adoption?? HOW MUCH DO YOU THINK ANNA NICOLE'S BABY IS WORTH??

probably if Larry birkhead was proving to be the father.because he new of all the drug use.so i would think he would of fought anna nicole for the baby.
