It was funny at No Way Out when he gave Taker the spinebuster. The crowd really didn't know what to do because they were not sure if it was a heel turn.
Basically, he has not turned heel. Taker and Batista are taking turns each week beating on each other because of the feud over the title, not because of a heel/face relationship. Their actions are more tweenerish than heelish.

Yes. He turned on Undertaker at No Way Out in retaliation for Undertakers Choke Slam on him on Raw a couple weeks ago. The official turn will be seen on Friday Night Smackdown when Batista tells the world why he did it.
Personally is anyone supprised though. Batista was already getting booed, WM was slated to have two Face vs. Face matches which are rare in themself, and Kennedy is on a fast rise on SD and is going to be the next face of SD. Plus the main event at No Way Out was 4 faces agenst each other. The match screamed a heel turn and Batista was the most logical choice. Now it would be fair to assume that I'm only saying it now after it happened. But I called this before it happened. Check out the question I asked before No Way Out.
