It is very disappointing that you can not find out whether a property has a lien or not.
In mortgage terms we have two kind of options, one is an equitable mortgage( depositing the original papaers of the said title), or a ragistered mortgage( ragistering the lien with the concerned ragistrar of properties). The second option attracts a stamp duty of 2% on the mortgage amount.
I tis really unfortunate that only 0.5% of the transactions go along with ragistered mortgage. So the best way to ensure that your property is not a lien anywhere is to see the original title documents of the property. Please avoid entering a transaction with the property owner showing you/dealing with certified true copies. Always examine the reverse side of the property papers to check the ragistration particulars. you can match the mentioned particulars with the records of the concerned sub ragistrar of properties. If the court ever marks a lien or deposits the title documents, it is always embossed on the reverse of the title papers.

Your property needs a title search. This is done when the property is in escrow . Try Fidelity Title . This company is nationwide. Ask your bank to do it for you

Check with any Title company in your area. Give them the address and they can do a title search for you. Beware however that you may be charged for this, depending on state rules.
