I recentley was involved in an accident after a night drinking at a bar. The bar staff took my keys from me early in the night, but after I became differcult and aggressive they gave them back to me to get me out.

While backing out of the carpark I was briefly distracted and didnt realise the handbrake was off, ended up rolling into a phonebox that was being used at the time, pinning an elderly woman inside for about 6 hours, while I was unconcious at the wheel.

Now the elderly woman is sueing me for mental anguish due to being trapped for so long.

I would like to sue the bar for letting me out of their premises with the keys to my vehicle, fully aware of my high level of intoxication at the time.

Has anyone had a similar case? and if so was it successful?

You are a symptom of what is dragging America down. You were not involved in an "accident", you were responsible for operating a motor vehicle while intoxicated. The bar did not force alcohol down your throat. The laws regarding this are ridiculous. Why do people that do idiotic things automatically look to someone else for responsibility for their actions? I am a bartender and also a person that patronizes bars. I am solely responsible for my actions and would never dream of suing someone else for my inability to exhibit self control.
You trapped her in a phone booth for 6 hours while you were unconscious? She didn't call the police? There was a phone right there. I don't believe your story, but have seen too many similar situations to emphatically dispute your claim.
People really are that dumb.

The bar and bartender can be held accountable--but let's face it, it was our elbows bending to get the booze inside us--no one poured it down our throats.

Let's face another fact--99 out of 100 drunk people will cause a commotion if they are not given back their keys--some have even gotten violent.

I remember someone who used to say, "I have to drive, I'm too drunk to walk." He was serious! I also remember someone else who stole a car when half-way home because he got too tired walking. Drunks will do pretty much what they want--not everyone on staff is able to stop them.

Are you drunk right now or something? Do you honestly think you'd win the case when you are the one who made the bad judgement in the first place! Nobody should have to be your baby sitter when you are a big boy now!

I hope that elderly woman wins and takes the clothes right off your back!

They need to throw your sorry drunken soul in prison for a few years and LET the old lady sue you to boot.

Go ahead and sue the bar.... If I get to be on the jury, I will find for the bar and order you pay THEIR legal fees also...
