He filed in 11/04. Not done yet as of 2/07. They have 2 kids and a house. Supposedly they both want it but why is it taking so long? He won't talk to me about it and that concerns me. I've been waiting by his side for about 2 years now but nothing seems to happen. She threatened to take him to the cleaners if she found he was seeing someone so we've kept it on the down low. Only people at both our jobs know.......should i be overly concerned?

He has not lived w/her since 8/04. He filed for separation in 9/04. He has been staying with me mainly (as long as we are not fighting).

My husband seperated from his EX in OCT 96 and their divorce wasnt final until JAN 98. This was a pretty straight forward, un-contested California divorce ( with children ). If the divorce is contested.....the final decree will not come until ALL parties involved have come to an agreement on ALL terms ( this part can take years if the ex is being nasty ).....this includes property division, monetary assets, child custody and visitation ( this is the worst.....you would not believe the things angry people will argue about ! ) child support, alimony, etc.... So Id have to say two years is not outside the norm......Especially with a b**ch for an EX ! ( I know she is after the comment about taking him to the cleaners if he sees some-one else )

Only your boyfriend can answer that. Divorces are a matter of public record and you can find out if it is final. If the paperwork you saw said "final judgment" then it should be final. Maybe your boyfriend for some reason or other doesn't want you to know that it is finished. I'm not sure where Cindy P is from, but my divorce with children involved did not take a year. My ex filed in October and ours was final in January. (3 months) The waiting period in Kansas was only 60 days.

Six months from the time they both show up to their court date.
They have very specific rules now. You have to file paperwork, go to a Parent Child Seminar regarding Parenting, Go to another appointment for working out terms, and then go before the judge. After that, the judge will sign off and still it takes 6 months from then to make sure no one has a complaint.

With kids..you are required to all of the above.

I just went thru this in CA myself with kids. it took approx. 2 years for it all to be completed. If the guy hasn't gone to any classes or appointments...he is lying to you and doesn't want the divorce.

California's contested divorces, especially with children, are mandatorily longer than six months at trial. I am not aware of the reasons behind this but I bet the judge and trial lawyers are starving and need the money. NOT!

There is mandatory papers exchanged and both sides meet with a mediator at least once, usually more. It drags out awhile. I got served June 2004 and my final jurisdiction on the kids wasn't until March 2005.

overly concerned or patient or pathetic for being with someone that you have to keep your relationship quiet about because of his pending relationship?

Let me tell you something...this could go on for YEARS!!! And even after it is final....with the kids involved, until they are 18 or 19....there will still be strings attached and she will have reasons as to why he will not be able to have someone with him in order for him to have his children be around him.....and you will have to "hide"....happened to my brother....so he waited or rather "hid" until the kids were grown....then after that was all said and done...she never did let him completely move in and eventually......well let's just say now they are through and he is down and out and lost out on alot of special ladies along the way. All the while i was telling him to RUN AWAY!

Yes you should be OVERLY concerned to say the least!

If he doesn't want to talk to you about it. Thats a clue, He doesnt want you or respect you enough to make this change happen. Maybe he doesnt really want the divorce. You need to talk to him about it ASAP. He is using u.!

uhh yeah...he's most likely having an affair with you. if they want a divorce they have to split up. as in, not live in the same place. tsk tsk...
