Re-possessing is the word you are looking for. You are taking something back that was in your possession originally. It is not stealing. That's what I tell myself anyway! LOL

In the example you give it could be called:
Recovering one's own property.
To say "stealing back"...would not be correct since the property always belonged to you, regardless of whose possession it was in.

The offense (other than stealing) that you might commit in this act of recovery could be in how you went about retrieving your property...
for example:
Breaking and entering
Trespassing
-------------------------------------------
The act of having one's previously stolen property returned:
Retrieving stolen property.
Example:
"Property which you have lost or which has been stolen from you can be viewed and retrieved from the property division of the Palm Springs Police Department."

Why steal it? If it is your s tell them that your taking what is rightfully yours and ask if they have proof that its is their's Or just take it back Oh proof goes both ways!
