A private individual can do this as long as they are a participant in the conversation. If they record two people talking and neither person knows they are being recorded, than no. You can record your own conversations with people though and use them as evidence in court.

If it's the police and they have a warrant that's a different story though. I don't know what that story is but I'm sure it's different!
