My husband and our daughter moved from Ca to Ky in Nov 06.
2 nights ago my husbands sidekick alarm went off ? It didnt wake him instead it woke me. So I started looking at it and seeing who he has been calling and I noticed that he has been making calls to some lawyers, old friends, and I also noticed that he had typed some notes regarding if he could take or 4 yr old out of state.Well in Oct we had just got back together from being seperated for 8 months from feb 06 to oct 06. We were seperated because he did not want to leave Ca to move to Ky. And then in Nov we moved. So I confronted him regarding this and asked him when he planned on leaving me ? He said that he is not happy, and that he was planning on taking our daughter. he said you can see her in the summer. So yesturday. when I got home. I noticed a uhaul attached to hes car. i left with my dghttr to file a epo, stayed gone until he got served. in (am) when we got home he was gone. court 3.07 Do you think he will show up ??

I doubt he'll show. Unless you're not telling us about some possible causes, on your part, which would explain both his wanting to take your daughter away and the "D". From what you are telling he sounds as if he may have been planning this "D" for some time. He did move you out of CA -a very liberal state with regard to "D"- to KY. Just be glad he's gone. Eventually the two of you could have caused real damage to the child. Only you know.

He can't just take off with your daughter, he can get temporary custody but if he doesn't allow you visitation then he is "withholding" her from you. When you are married you have equal rights to the child he can't do anything. Until there is legal paper work stating temporary custody then nothing is going to happen.
I do advise you to go to a lawyer and file first, that way the child will remain with you until the final judgment on the custody.

The emergency order of protection is only good for 30 days . He will have to be served and appear in court to get one any longer.
It wouldn't be in his best intrest to show, so I say he wont be there. File for a divorce on grounds of abondanment and publish his name. If he don't show at least u will be divorced and will have a child support order in place for the next time you see him. Good luck

It would be to his best interest if he shows up but if he chooses not to,he will only hurt himself and can never change the outcome. If he doesnt show the judge will grant you everything you wanted automatically and he can never go back to court to change it. Also if he does the courts usually award custody of any children to their mother unless proven unfit so any attorney he contacted would have told him this, so maybe if he figures hes going to lose anyway he just took off. I do not feel he will show up. You need to get a lawyer or attorney now and do not wait... I feel he is going to file for divorce and try getting custody of your little girl on you. You need to be geared up and ready to fight in court for your daughter. You need to at least get joint custody so he does not have the say. Whatever you do stop him from taking her out of state. Start taking action now and do not wait !

"i left with my dghttr to file a epo" so am I right in assuming that you have your daughter? If I am then you need to see a lawyer pronto and have seperation papers drawn up stating that he can NOT take her out of state without your written/notarized permission. Also have it stated in the seperation papers that in the event you get a divorce the visitaion of your daughter will be in HER home state (where you live of course), and she is not to leae that state without your written/notarized permission...Do it NOW.

it sounds like he's gone unless he thinks he has a chance of getting your daughter legally. thank god you found out before he left with your daughter without your knowledge. i'd file a restraining order to try to keep him from coming back and kidnapping her. Be very wary, you never know what people are capable of doing when desperate. If moving is a viable option, do it. You'll be much safer.

not sure why we'd know the intentions of your husband, you know him better than anyone. however it's good to know you have your daughter with you. just get yourself lawyered up. and make sure your representative is taking care of your legal rights! from this point on it'll be rough and tough. be calm. the day i was served papers is the day i let go of him coming back. his wife thinks i havent let go because, i'm guessing, i'm not dating and i still love him. but my therapist and the divorce book i read insisted that true healing comes from not expecting "fantasies" to come true. so tune in to what you know and be logical. letting go does NOT mean you stop loving your husband or stop regretting the divorce. it means you let go of the unrealistic expectations that the marraige can or should work. good luck!

sweetie...you need to consult a lawyer regarding this situation. anytime you notice that he has been contacting lawyers it means that he is preparing to leave you and is getting his legal and financial ducks in order before he does. don't just sit there and ask questions to yahoo answers. take yourself to a lawyer and protect your asseets and your finances and your daughter. he can't just take your daughter out of state without your permission and without your knowledge. cause you could file a kidnapping charge against him for doing so. GO TO A LAWYER.

There are lots of good answers already here so I will just say how sorry I am that you are going through all this. I am so glad that you were able to get an emergency order and prevent him from taking your little girl.
