I am thinking of starting a nursery and know you are not supposed to use copyrighted or trademarked plants, but don't know how to tell when I look them up on line.

I should have said if plants have trademark or patent. I do plan on selling after I have propagated them.

Ok, let's try again. I am going to start a nursery. Some plants have a patent or trademark. I cannot sell those. There are lots and lots and lots of plants that do not have a patent or trademark. I just don't know how to tell if they do, by looking the up on the internet. Thank you,

How are you planning to stock your nursery? If you purchase plants wholesale, the copyright is satisfied. If you are going to propagate, you'll have to apply for one. Seems like a lot of work to me when you can just buy from the wholesaler!

You can do what you want as long as yu do not go into business selling a patented plant type
