All in the name of Inter-State Commerce. If a State refuses to comply with an issue, it is referred to as an obstacle to Inter-State Commerce. This has been used for bad and good practices. At one time, James Carter pushed 55mph as the most efficient speed for all cars and all transmissions. Silly as that is, the Federal Govt threatened all Highway funds to States that didn't comply. (seems like a great way to get People into airplanes)Funds were also threatened to those States that were not enforcing the Civil Rights Act, which is the only reason Southern States begrudgingly complied. Just like many other issues, it is the good intentions of Elected Officials which have opened to door to the enforcement of bad ideas. To fix this, the Scope & Scale of Federal programs must be reduced. As long as States are addicted to Federal Funds, they will be obliged to enact and enforce Laws not supported by the vote of their people. This can have negative concequences too. It will take creative minds to find a workable solution. Untill then, this is as good as it gets!

No challenge has ever been launched based on the 10th amendment. That's strange, because the federal government for decades has meddled in things NOT given to it by the constitution, which means they are state issue. You name it - education, health care, marijuna regulations - all are issues for state regulation, yet there are no challenges.

The reason - states like the federal dollars they get for giving up their rights.

It's mostly the 10th. My guess is that most people, including legislators & judges have never read the Constitution. I'm sure that 95% of editorial writers have not read the Constitution.

Ok, for starters the previous answerer (lad whatever) has a problem. But seriously, how many people can name their amendments. As long as everyone is distracted with American Idol, or Britney or Anna Nicole Smith's cadaver what can you do about it? I really fear that your question, as important as it may be, is really falling on deaf ears. More importantly, it's undeniably intentional. Write your congressman, hah!

The govt. is out of control as the founding fathers knew it would become. We are no longer ruled by law, but by men. This is very clear. When we restore the rule of law, we will have our freedom back.
